1. Agreement to Terms
By accessing or using the Tensity Group website and services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use our website or services. These Terms constitute a legally binding agreement between you and Tensity Group.
2. About Our Services
Tensity Group provides behavioral intelligence consulting services, including but not limited to behavioral hiring intelligence, team dynamics and pressure mapping, leadership under pressure advisory, and organizational stress-response diagnostics. Founded in Australia and operating globally, we are a collective of specialists combining behavioral science, AI modeling, systems engineering, and commercial strategy. Our services are designed for business-to-business (B2B) engagements and are delivered under separate consulting agreements specific to each engagement.
3. Use of Our Website
You agree to use our website only for lawful purposes and in a manner that does not:
- Infringe the rights of, or restrict or inhibit the use and enjoyment of this website by, any third party
- Breach any applicable local, national, or international law or regulation
- Attempt to gain unauthorized access to our systems, data, or networks
- Introduce viruses, trojans, worms, or other malicious or technologically harmful material
- Collect or harvest any information from the website without our prior written consent
4. Consulting Engagements
All consulting services are governed by separate engagement agreements (“Statements of Work” or “Service Agreements”) executed between Tensity Group and the client organization. These Terms apply to website usage and general interactions; specific service terms, deliverables, timelines, and fees are defined in the applicable engagement agreement.
5. Intellectual Property
All content on this website — including text, graphics, logos, methodologies, frameworks, and software — is the property of Tensity Group or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent.
Behavioral intelligence methodologies, the A-I-N-E Operational Intelligence Cycle, assessment frameworks, stress-modeling systems, pressure dashboards, scoring engines, and analytical tools developed by Tensity Group remain our exclusive intellectual property, even when applied during client engagements, unless expressly agreed otherwise in writing.
6. Confidentiality
We treat all client information, assessment data, and engagement details as strictly confidential. We will not disclose confidential information to third parties except as required by law, with your written consent, or to trusted service providers bound by confidentiality obligations. This obligation survives the termination of any engagement.
7. Data Protection & Privacy
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using our services, you acknowledge that you have read and understood our Privacy Policy.
8. Disclaimers
Our services provide behavioral intelligence and analysis based on established methodologies and professional expertise. However:
- Our assessments, pressure maps, and reports are advisory in nature and do not constitute legal, medical, psychological, or employment advice
- Behavioral and stress-response analysis involves inherent uncertainty — our insights are probabilistic, not deterministic
- Hiring, team management, and leadership decisions remain the sole responsibility of the client organization
- We do not guarantee specific business outcomes from the application of our recommendations
- Website content is provided for general informational purposes and should not be relied upon as professional advice
9. Limitation of Liability
To the maximum extent permitted by law, Tensity Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of our website or services.
Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the fees paid by you to Tensity Group for the specific engagement giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or personal injury caused by negligence.
10. Indemnification
You agree to indemnify and hold harmless Tensity Group, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your use of our website, or your misuse of any information or reports provided through our services.
11. Third-Party Links
Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites. Inclusion of a link does not imply endorsement.
12. Termination
We reserve the right to suspend or terminate your access to our website at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Provisions that by their nature should survive termination shall survive, including intellectual property, confidentiality, limitation of liability, and indemnification.
13. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the relevant engagement is contracted. Tensity Group was founded in Australia, and in the absence of a specific engagement agreement specifying otherwise, these Terms shall be governed by the laws of Australia. Any disputes shall first be attempted to be resolved through good-faith negotiation. For clients in the European Economic Area, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated “Last updated” date. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
